Whoo boy, here we go . . .
While that may technically be true, you are guaranteed a ride to jail if you refuse. And your car will likely be towed as well.
If you got nothin' to worry about, why go head to head with a cop? Makes no sense at all.
This thread cracks me up. So much righteous indignation that is totally misinformed. No wonder the cops f*ck with y'all.
This is true. Its just like refusing to sign a ticket. You get the cuffs, your car goes to impound, and you go directly to jail.
There is no reason to be stubborn or defiant. That will get you nothing but bad things.

If they want to check you car out, they're probably going to do so one way or another, wether you like it or not. Probably cause is funny like that.
Exactly.
And even if there was NO probable cause, and you later get the charges thrown out on a motion to suppress, you have still had to suffer a day in jail, having your car towed (which we all know means having your car raped, scraped, and your stuff stolen, at least here in CA).
So again, why would you do someting so boneheaded?
Matt, your statement that you just "stand in front of license plate so the cop can't see it" is absurd. Talk about providing a cop with probable cause for a search, or at the very least, a warrants check.
This thread should be entitled "When Guys Who Drive Good Cars Turn Dumb." LOL.

A little respect for authority goes a long way. Some people take that as submitting to some kind of domination. The funny thing is, if you dont get along with the officer you interact with, theres a good chance you'll end up "submitting to domination", so to speak, as you sit in jail. There are mean, bad people in there. We're not talking about the principles office or time out. Serious stuff.
I think around here its like 400 bucks to get your car out of impound. Not up for discussion. You pay that or your car gets auctioned off, regardless of whos at fault.
This isn't some kind of game. The law is serious business. I wouldnt be screwing around there.

Ah yes, impound. Reason enough to mind your manners. I must admit that I was "young, dumb and full of cum" until, well, until I started writing this sentence. LOL.
But a few years ago I paid the reg. fees on my 535is, but never got around to getting the required bi-annual smog check. So, although my fees were paid, I didn't have a current tag on my plate. I was distracted by the birth of our kid, new job, etc.
So I get pulled over. Cop points out that my reg has been expired for 6 months and TWO DAYS, and since it's more than 6 months expired he is going to tow my car. I beg, I plead, with him and his sargeant. No dice - the car is a goner. So I clear out as much of my stuff as I can carry. You know what I mean - the leatherman tool and other goodies in the glove box. Radio faceplate, etc. But I forgot to remove the ten-disk CD magazine from the CD changer.
When I go fetch my car some $$hundres$$ of dollars later, I find that some f*ckers took the CD magazine with 10 rare disks, rifled the glove box, and then DREW A MAP ON MY TRUNKLID. When I was waiting for the manager to come over so I could show the damage to my trunk, I watch in horror as a then-new Porsche 911 Carrera 4 is hauled out of storage by that fork-lift type hauler they use to push cars around the impound lot. And the Porsche, being carried with its rear wheels about three feet off the ground, SLIDES OFF THE FORKLIFT AND DROPS HARD ON ITS SIDE. Just barely missed rolling over. OMFG! No visible damage, but gee, you think something might have gotten tweaked?!
Anyway, that story alone should be enough to inspire you to 'RISE ABOVE' if you feel the cop is treating you unfairly. If you have kids, tell yourself your kids need you. If you don't have kids, tell yourself that your CAR needs you.
Peace out,
CD

And I'm sure they're not responsible for any damages caused on the impound lot.

Damn, California Dreamin' and Turbodan -- Y'all sure took my statement about what you don't
have to do and ran with it the wrong way.
I wasn't advocating any disrespect for authority. I wasn't advocating acting like an "I know my rights!" kind of jerk. I was merely responding factually to the statement I quoted.
As to field sobriety tests, I can't count ten letters backwards from any given letter or walk straight along a narrow line no matter what condition I'm in, so I'd decline those in favor of going straight to the breathalyzer.

i never understood why they would make you take a sobriety test Anyway if you can just do the breathalyzer

Ok, Shawn, I hear you. I have done the same thing when I knew I wasn't over the limit. I offered to take the Preliminary Alcohol Screening test (that little party-favor thingy the cop carries in the car) just to be done with it. But remember, you don't have to be over the legal limit of 0.08% blood alcohol concentration to be arrested and prosecuted for "driving while under the influence." The cop can haul you in anyway, and one's attitude may play a role in how one is treated.
I'll leave you with the image of that poor Porsche driver finally retrieving his new $85k car and driving away, only to notice an odd knocking sound and a slight pull to the left . . . D'oh!

Think of it as a series of progressive steps. LOE can't just jump straight to breathalyzer, just because he observed an objective symptom of intoxication.
Reasonable suspicion that a law has been broken, or will be if you're not pulled over = traffic stop.
Objective symptoms of intoxication (red/glassy/bloodshot eyes, odor of alcohol, unsteady gait) = probable cause to ask you to submit to Field Sobriety Test.
Failed FST's = probable cause to ask you to submit to Preliminary Alcohol Screening (the in-the-field breath tester).
Any of the above, mixed with bad attitude or belief that your'e a menace = bracelets for you and your ride, and kissing the big Bertha intoxilyzer at the station.

cant you just tell the cop to do the breathalyzer instead of doing the "walk in a straight line"?

No, they require probable cause unless you either agree directly or tacitly. It's easy to run roughshod over folks if they don't know their rights.

Crazy. here they require *consent. I dont know about alberta, but in Florida it was a condition on your license, you don't have to do the test but you would get like a 24 hour suspension or something.
You're not kidding about running roughshod over those who dont know their rights. When I was a teenager and would get the usual harassment, I had no idea what they could or could not do.. so I let them do whatever.

Doesn't help that nowhere in the US jives with alot of those laws. Canada's probably no better across the provinces. Some things are pretty universal. Insure your car is one.. proof of ownership at least is another.
Bet most people didn't know in Alberta those fart can mufflers are ILLEGAL. something written into the roads act about an exhaust where the outlet is larger then the inlet (its basically a rice tax).

Yeah, nightmare is right. They also took a cool monocular/spotter scope, a swiss army knife I thought no one would care about, and a nice lighter.

But the map, clearly drawn with a licked wet finger, was a major insult.
I put in the claim form, like they tell you. They stonewall you, ask for you to submit more evidence. I do, they deny the claim, and then it's off to small claims court. Figured they owed me something, but I never filed a small claims action. Too busy taking care of business, ya know? Breaks your heart when other shite takes precedence over your chariot, huh?
