That's a funny clip if it was't for the fact she suing. I hope she loses badly. Could a U.S judge really allow the suit even though the video clearly shows her getting up straight away and is there O.K? Also the security guards are not medics so cannot assess the silly woman medically. Also if I was one of those secuirty guards I would have laughed too. I wouldn't have posted it on youtube though. Unfortunatley cases like this are brought regularly here in the U.K too, people tripping over a broken paving slab, people suing the council over a pothole in the road that bent there alloy wheels.............. Look where you are going.

The problem is that in our system, judges can sanction lawyers for frivolous claims, but for some reason, institutionally they are afraid or perhaps the better word is hesitant to do so. How this case wound up in a MD court is still a mystery to me, but my wife moved for fees against the plaintiff and while the case was quickly dismissed due to lack of any kind of jurisdiction, the sanctions were denied. Even though it was a very egregious abuse of the MD courts. It is what it is.

This is why I like living in a state that still has contributory negligence. This seems like one of those times where it would actually be useful.

My opinion is the Mall probably will settle just to avoid bad publicity. They may be liable for some type of defamation of character or privacy by allowing the video to be posted online, but it's doubtful for any type of negligence or tort action for the actual fall since it is obviously her fault.
